OBBBA Update — For 2026 payments reported in 2027, Form 1099-MISC, Box 3, royalty reporting is still $10 or more. The new $2,000 OBBBA threshold doesn't apply to royalties. Backup withholding still remains reportable at 24%, even below the filing threshold.

What is Form 1099-K?

During the tax year, payments and transactions made through third-party networks, payment platforms, and payment card processors are reported on IRS Form 1099-K. For each calendar year, a payment settlement entity (PSE) is required to file Form 1099-K to report the gross amount of reportable transactions defined if a payee and a card is not settled or paid to both the payee and the IRS.

Note: Even if a payee does not receive Form 1099-K because the TPSO threshold was not met, taxable income from goods or services provided must still be reported on the payee's tax return.

Who needs to file Form 1099-K?

Payment card companies, payment apps, and online marketplaces are required to fill out Form 1099-K and send it to the IRS each year. They must also send a copy to the recipient by January 31.

Box 1a - Gross Amount of Payment Card/Third-party Network Transactions

Use this box to report the gross amount of payment card/third-party network payments made during the calendar year.

Box 1b - Card Not Present Transactions

Box 2 - Merchant Category Code
